Terms of Service

These terms apply when you buy from Container Shelters or use our website. We've kept them as plain as we can. Please read them before you order.

1. Agreeing to these terms

By using our products, services and website, you agree to these terms of service. They are here so that you and Container Shelters are clear on who is responsible for what.

2. Council consents

Our shelters are versatile and adaptable, but complying with local regulations is essential.

• Your responsibility: You are solely responsible for obtaining any council consents or approvals required to install and use your shelter.
• Our liability: Container Shelters is not accountable for any consequences of a customer failing to secure the necessary consents.
• Check locally: Not every shelter requires council consent. Talk to your local authority to confirm what applies to your location and intended use.

3. Engineer-approved structures

For performance and safety, all shelters must be securely installed on an engineer-approved structure.

• Foundations: Proper screw piles, ballast or other approved foundations must be used, as specified by a qualified engineering professional.
• Certification: You must obtain sign-off from a qualified engineer confirming the structural integrity and suitability of the foundation.
• If this isn't done: Failing to meet these requirements may result in damage to the shelter, and will void the warranty and any other guarantees provided by Container Shelters.

4. Installation and use

• Installation: Shelters must be installed following the assembly instructions provided. Professional installation by certified personnel is strongly recommended.
• Intended use: Shelters must be used only for their intended purpose and within their specified load ratings. Improper use or overloading may compromise safety and void the warranty.
• Maintenance: Regular maintenance is required, including tightening bolts, inspecting covers and repairing minor damage. See our maintenance tips.

5. Warranty

Our shelters carry a 10-year parts warranty. The full terms are on our Warranty Information page.

• Exclusions: The warranty does not cover damage resulting from improper installation, misuse, non-compliance with council regulations, or exposure to conditions outside the shelter's specified ratings.
• Voided cover: Damage caused by not complying with these terms, including the lack of engineer-approved foundations, voids the warranty.

6. Liability

• Limitation of liability: To the extent permitted by law, Container Shelters is not liable for any direct, indirect, incidental or consequential damages resulting from the use, misuse or inability to use our shelters or products.
• Acts of nature: Damage caused by natural disasters, such as earthquakes, floods and cyclones, is not covered under our warranty or these terms.
• Product information: Product descriptions, specifications and pricing may change without notice. We reserve the right to correct any errors or omissions.
• Your consumer rights: Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993.

7. Shipping and delivery

• Timeframes: Delivery timeframes are estimates and may vary because of factors beyond our control.
• Your part: You are responsible for providing accurate delivery information and safe access for delivery vehicles.
• Transit damage: Any damage in transit must be reported to us within 48 hours of delivery.

8. Returns and refunds

Returns and refunds are handled under our Returns & Refunds policy. All returns must be approved by our team before anything is sent back, and products must be returned in their original condition with all components included.

9. Governing law

These terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the New Zealand courts.

10. Changes to these terms

We may update these terms at any time without prior notice. Please check back from time to time for changes.
